Training Fees
The client agrees to pay the trainer a nonrefundable fee for a single session or package of sessions to be paid at first session. All sessions must be completed within 6 months from the date of commencement of contract or they will be forfeited.
Dog Health and Vaccinations
The client warrants that the dog is free of fleas, parasites, and infectious diseases. Client must provide proof of vaccines prior to participating in group classes.
Acknowledgment
The client understands that the trainer makes no guarantees that the dog can be trained, that the dog will never bite, that the dog will never be dangerous or vicious in the future, or that the dog will not exhibit other behavioral problems in the future. Training will last for any particular amount of time as each dog is uniquely different. Client understands that successful training requires continued training in-between professional sessions. Follow-up and scheduling of future training sessions is the dogowner’s responsibility.
Training Services
The trainer offers a variety of dog training services including agility, obedience, nose work and “working dog” training. We use all four quadrants of operant conditioning to teach dogs of all disciplines. The trainer understands that all dogs and their owners have different needs and goals and will do our best to work towards those goals. The trainer does not “fix” dogs or their “behaviors”; but, we will assist you in modifying and maintaining behavior to make the relationship between you and your canine companion even stronger.
The trainer will provide lessons for you and your dog on a lesson-by-lesson basis, the goal of these sessions will be to teach you how to train and work with your dog using all four quadrants of operant conditioning. The trainer will make every reasonable effort to help you achieve training and behavior modification goals but makes no guarantee of the dog’s performance or behavior as a result of providing professional animal behavior consultation. You understand that you and members of the household must follow the trainer’s instructions without modification, work with the dog daily or as recommended, and consistently reinforce training as instructed by the trainer.
Cancellation and Other Policies
Client understands that a “no-show” for a scheduled appointment will be counted as a “payable” lesson. Any session reschedule requests must be submitted via email or phone 24 hours prior to scheduled time. The client agrees that lesson duration is determined by the trainer at the time of service; and, time spent during appointments discussing client’s dog, dog training and/or behavior is considered training/lesson time.
Termination
Client’s services shall terminate if (a) Trainer feels the Dog is too dangerous, (b) Client breaches any term or condition of this Agreement, or (c) Client or Trainer requests service termination. Upon termination any outstanding debt becomes payable.
Refunds
No refunds will be available unless agreed in writing by the trainer.
Release of Liability and Indemnification: Trainer holds a Master Trainer Certification from Highland Canine LLC, a program approved by the North Carolina Board of Community Colleges and a Patrol/Detector Dog Trainer Certification from American K-9 Interdiction LLC, a program approved by the State Council of Higher Eductation for Virginia. Client understands and acknowledges the elimination or modification of behaviors is not guaranteed. Client acknowledges that dog training will not provide exact results and that failure to follow the professional advice given to them by the trainer may result in an escalation of behavior and training issues. Client agrees to accept responsibility for any reasonable damages their dog may cause. Client agrees that if their dog is injured in a dog fight or accident, gets fleas, ticks or worms, contracts any illness or disease, is lost or stolen, becomes pregnant, or engages in any dangerous, vicious or unwanted behavior, during or after all services provided by trainer, on or off trainer premises, client’s home or business or any other location, that the client accepts the risk and agrees that trainer shall not be held responsible for it or any resulting injuries, losses, damages, costs or expenses.
Binding Agreement
This Agreement is binding upon client, spouse of client, and children of client. This Agreement supersedes all prior discussions, representations, warranties, and agreements of the parties, and expresses the entire agreement between the client and trainer regarding the matters described above. This Agreement may only be amended in writing, signed by both the client and the trainer.
Arbitration
In the event a dispute shall arise between the parties, the dispute shall be referred to The American Arbitration Association. The site of the hearing shall be in Douglas County, Colorado and in accordance with The American Arbitration Association Rules and Procedures. The arbitrator's decision shall be final and legally binding, and judgment may be entered thereon. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party challenges the arbitrator's decision, the other party is entitled to all reasonable attorney’s fees for having to compel, defend, or enforce the award.
Photo Release
Client grants to the trainer, its representatives, and employees, the right to take photographs of the client and/or dog, and to copyright, use, and publish any photos within the scope of dog training, or advertisement of the business.
